SEPA Determination of Nonsignificance for Draft Biosolids General Permit

Ecology reissued a SEPA Determination of Nonsignificance for the Draft Biosolids General Permit on September, 27, 2024. 


Following an appeal, the Pollution Control Hearings Board (PCHB) determined that the Determination of Nonsignificance (DNS) issued for the general permit in 2021 was inadequate and ordered Ecology to revisit the DNS and include information specifically relating to PFAS, PBDEs and microplastics.


In issuing the General Permit in 2022 and accompanying SEPA determination, the biosolids program considered contaminants of concern and potential impacts to human health and the environment. We spoke at length about these topics in the PFAS Chemical Action Plan published in 2021, as well as the Response to Comments received on the Draft General Permit published in 2022. We also continue monitoring studies on pollutants in biosolids, including work in other states and by the EPA. 


Since receiving the PCHB’s summary judgement, we have been working to appropriately document this research and analysis and include it in our SEPA checklist and determination for the General Permit.
